Good morning, Councilmember Orange, and members of the Committee on Government Operations.

I am Devon Brown, Director of the DC Department of Corrections. I appear before you today to discuss the department’s compliance with the Local, Small, and Disadvantaged Business Enterprise Act.

I am pleased to report that for Fiscal Year 2005 (FY 05), the Department of Corrections exceeded its goal to support and utilize local, small and disadvantage business enterprises (LSDBE) in the District of Columbia. The department’s total budget for FY 05 was $124,114,423. The expendable budget for FY 05 was $7,103,439 and of this budget, the department set aside the required 50 percent or $3,551,720 for LSDBE activity. The total dollars the Department of Corrections expended with LSDBEs in FY 05 was $7,103,439, which was more than 200 percent over the goal set.

The Department of Corrections awarded contracts to (27) LSDBEs in FY 05. All were included in the Office of Local Business Development database as certified businesses based in the District of Columbia. Of these small, locally-based businesses, forty-eight (48) percent were "Disadvantaged Businesses.”

LSDBE compliance is a performance requirement for the Department of Corrections’ Director.  The Department of Corrections does not have an internal LSBDE Utilization Policy, but continues to follow the District’s established LSDBE policy.

The Department of Corrections is committed to ensuring compliance with the LSDBE Act and will continue to strive to exceed its assigned goals related to eligible businesses.
